Well it seems work are playing the royal ream again.
Fellow work mate has been on return to work program for a couple of years now after having tendinitis in both hands repaired, got a phone call at dinner time last night saying if he didn't receive a 100% fit for work from the specialist then don't bother coming in Friday...
WTF. Not sure how they can do this.
Will be an interesting day, this is when your glad to have strong union backing on the site, this fellow is actually a rep..

But surely he needs an opportunity to make that appointment with the specialist, cos normally they are not easy to get at short notice.

They need to give him reasonable notice, but unfortunately if he is unfit for his normal duties after an extended period they can terminate him.

IMO no such thing as light duties you either can or you can't. plus not fair on workmates on the same pay rate, cause a lot rort the system

Yea I see both sides, thing is he has been ramping up the work load and can carry out in say 80% of his duties.
I think his only activity restrictions now are limit the long period of hand tool use, so 8 hours on a glider sorta thing.
Anyway yea I would have thought he'd need some sorta notice, nit a call at dinner..
Seems sus to as we are currently undergoing an eba where they wanna screw us, remove our morning smokeo and cut the 20min lunch to 10 and have us work back 10...
And this bloke is our no.1 union rep...

That sounds really sus. He should know they need to give him notice then. I didnt see in my earlier comment that he was working, i thought he had been at home the whole time. Since hes working, thats pretty much unfair dismissal.

They cannot dismiss him because he does not upgrade to PID,s. That is illegal in any state under w/comp. Depending on the state there are rules to let a worker go if they cannot perfor their PID,s and thereare no alternate duties. 2 years after surgery for both hands is not unusual though.

I say 2 years but they did one at a time so he still could carry out duties easier.. So oops were spaced about a year apart. So first hand is about 2 years on and second about 1 year, probably less..
Yea I'll see how he is in the morning..
