RACV vehicle test done - ok result. car purchased its a lemon - should RACV compensat

    Hi

I purchase an auto Nissan Patrol, Had the RACV vehicle inspection done before purchase. Report came back fine

But within days, within a few kms of driving it, I became aware of an issue with the Transmission.

Long story short, every maybe 1-5 to 1-10 occasions when I would pull up to a stop at a set of lights, then take off, the car is crawling away in 4th gear. Only way to short term fix it is turn the engine off & on and that fixes it, otherwise, every subsequent stop, the car crawls away in 4th gear. Then within a short time the issue re occurs

I have not seen my car in 4 months, been through 4 different mechanics, issue finally isolated to the Transmission control module, but still getting fixed / new part replacement required etc.

    This is costing me 000's.

I know in RACV's fine print it states they cannot identify all possible sporadic mechanical issues.

I'm just wondering if I have anything I can go on here, should RACV be compensating me here. Is their fine print worth the paper its written on.

Who could I get advice from....

Maybe contact consumer affairs and see where you stand in regards to this.

I have no idea how you stand with regard to the RACV pre-purchase inspection, but would think they have themselves covered for such situations. I had an RACV test done before buying my Patrol, but with almost opposite results to you.The test reported that the manual transmission had major problems. I wasn’t certain about this so paid a 4wd transmission specialist to check it out. They confirmed that it was in perfect condition, seems that the RACV tester was not familiar with the ‘standard’ Patrol transmission ‘growl’. I wouldn’t bother with an RACV pre-purchase inspection again.

Unfortunately whilst your symptoms appear they they should have been easily identified by racv, I also don't believe they're worth the paper they're written on unfortunately, especially for 4wd's.... Racv would without a doubt cover themselves for these situations.

If problem only occurs 1 in 5 or 1 in 10 times, the RACV tester probably did not notice the problem as you did not notice it when you test drove the vehicle before purchase.
If you purchased it from a dealer, perhaps there is some warranty.
At the end of the day, all you have is yourself and all you need is your friends (and in our case our Patrol)
