It may be necessary to legislate and implement such laws federally. As long as loopholes available in the law to ask for suspended jail terms the magistrates may be powerless to handover fixed jail terms. I may be wrong, but he was able to get bail without much hardship by the sound of it, regardless of overwhelming evidence of the surveillance video recording. It is hard to know what happened in the court room, but defense lawyers usually are able to ask for bail and suspended jail terms when there are provisions available in the law. As far as I know, it is still quite possible to avoid any real jail terms in Australia with such transgressions. Being under the influence of a drug or alcohol is still an acceptable defense there. We need to see these things from victim's perspective. Victim get even more traumatized through the system when he or she tries to get medical assistance or compensation. Therefore, it is no joy ride for the victim. The criminal may have had bad childhood, trauma, bad parents et cetera, but the cycle must be broken by not allowing such damaged people to pass their bad life, bad upbringing to people that have nothing to do with their anger. Mandatory sentencing without wasting court's time is the best approach in my understanding. If the law is there to support the prosecutors, the need for bail applications may not be necessary with clear evidence cases like the above.
And that's about as ridiculous as it is in reality. Need laws to say drugs and alcohol can't be used as excuses for committing crime. And I'd bet my house there are more people who had rough upbringings who are now model citizens than those who use it as an excuse for their crimes. Your past shouldnt be an excuse for bashing people last weekend.
The issue is that your country does have laws protecting such transgressors. You can get drunk, then hit and kill somebody and getaway with it with a slap on the wrist. The maximum that I have seen so far is a two year jail term with parole or possibility of parole. Since the intention and motivation to kill isn't there, it is hard to prosecute even for manslaughter under Australian law if I am correct, so the verdict is usually a mild one. I won't be surprised if the transgressor won't get a day behind bars in the above incident. However, the victim will be bestowed with a real jail term by the health and welfare system.
Leaving the kimberly for central oz . Its friggin freezing here.

It was very good Marko. Lots to see for everyone!
Lot of new products and ideas as always.
They have a "Base camp" section in the middle with rides for kids etc ...
I suggest to attack it early bird style mate and park off Langs Rd before that parking lot gets full . Otherwise you'll end up on the racecourse and have to shuttle it to the event.
Also there is some shitty weather predicted for the weekend if you haven't seen so rug up !! Sent from my SM-N920I using Tapatalk
Cheers Hodgey, thanks for the parking lot tips too!

Definitely a wise move Mark! I'm glad you mentioned that.
The car park alone is a show in itself, for the shady variety of souls out there...
2011 show, my Navara got ransacked. UHF aerial, arb spotties got taken and for whatever pleasure they got out of it... they also punctured my headlights.
Rsole act that Hodgey mate, what priicks!!
Unsure why excessive force is so legally frowned upon if you were to catch the buggers in the act!
Used to skin rabbits by hooking their little necks in the old tiny winch hook, that should suffice!

Come on MB, its not their fault. They see the results of someone else's effort and believe they deserve a bit too, so, I think you should pre-loosen the bolts and leave the spanner kit in a nice carry bag so these treasures of humanity can do their shopping without any effort involved. If you are going to blame anyone, look at the badger that snarled at him when he was 5 years old - thats the reason there is so much crime - angry badgers.

Here’s a copy & paste for us Umans!

Not so much angry more like pissed off the timing is out on the zd30
Didn't know you had to lock the ring gear before taking the pump out
ah well lesson learnt start again Monday will just pull a part the front of
the motor to get to timing gears to line up
any one have an idea on how to undo the crankshaft nut .......easily
Bugger Roofy sux mate. Not sure on the front crank nut it's a big bugger, looong breaker bar or bloody good impact? Why does the crank nut have to come off?
Sent from my SM-G930F using Tapatalk
If eng out, lock up flywheel and you need to give the nut a sudden knock force with hammer or lump of wood using a ring spanner or socket & bar what ever U are using. A sudden impact force has far greater effect than just applying pressure/torque. If engine is in veh & transmission connected, locate breaker bar against something solid and some give the starter a flick. Or try just putting in 1st gear, get someone to put foot on brake/hand brake(all) and give the ring or socket/bar a sudden knock like when locking the flywheel. Rather use a socket and breaker bar.
