No, sorry a refund will no be suitable.
Your ebay password is your responsibility and yours alone. If my account was hacked and the hacker purchased hundreds of your most expensive items you would be expecting payment wouldn't you, so why should it be different for me?
I understand you would not want to receive any extra negative feedback and that is not my intention. Negative feedback can be avoided by you the seller abiding by the seller performance standards in Ebay's policies, which state that when a buyer wins an item on eBay, the seller and buyer have entered a contract that both members are expected to honor.
As money has already been paid into your paypal account for the above listing I have honored my part of the contract and I expect your store to do the same. I will be expecting the item to be posted 1-2 day after payment verification as per your original listing.
Please note that if you fail to meet the minimum performance standards, your search placement is likely to be lowered, there maybe limits applied to your selling activity or you may be restricted from selling items on Ebay altogether.

Sorry no compensation will be accepted as when I paid for this product we entered a binding contract, as I said earlier I expect to be notified of the product being posted on Tuesday.

Failing to receive confirmation of the item being posted by the end of Tuesday will result in a negative review and a formal complaint to ebay, also forwarding all communications between us including your claim that they notified you of your supposed hacking and took no further action.

got the same wank of an email back saying some rubbish about a chinesese email with too many hard to pronounce r's or some rubbish and he could give me a nice shiny $15 dollarr coin as compensation.

My understanding is that we have entered a contract for Sale and supply of the item as per the rules of ebay. I have paid in good faith the full amount of your "Buy Now" plus the stipulated postage amount and i am clear that your obligation is to provide the item as per the listing. You note also that the item is located in Sydney and the delivery time is 2 to 7 days.

I think that we all should write different emails but use the same basic points. I am a little concerned even about this thread. Id hate to jeopardise our chances if the seller can present a conspiracy theory to eBay and have us all bumped.??? Or Not?
I felt a little sorry for the seller if it was some Aussie Bloke trying to make a living on eBay but i think its a larger Chinese company and they can give a little back ;)

Yeah, I think we're safe talking about it on here, i'm still standing by the contract between the buyer and the seller, nissanpatrol.com.au has nothing to do with it, but I see the concurn. For that matter I have no idea what ebay hongkong has to do with it either.
I felt a little bad too, but then i thought if someone hacked my ebay and bought a heap of sh1t, they'd all expect me to pay, and if i didn't they'd all call me a cee-you-n-t i'm sure. so bugger em.
I see on his store he has "Regular 35% of sales", so must have a bit of fat on some gear, so worth while seeing how far we get i'd say.
