View Full Version : New Drink Driving Penalties for Victorians

Something that every Victorian driver should be aware of AS OF TODAY.

Mandatory loss of licence, Alcohol education course & an alcohol interlock fitted to car when licence is re-obtained for *ALL* drink driving offences.

And don't forget that since January 2018 that if the offence occurs in another state Victorians still receive the same penalties as they would in Victoria.

Also
Vehicle and Trailer Inspection Powers.

Section 13 of the Road Safety Act also starts today, allowing police to conduct random safety inspections of any motor vehicle or trailer located in a
public place, whether or not the vehicle is attended.

Previously the owner/operator had to be present which had been a problem to cops when confronted with a parked vehicle with obvious defects and being unable to wait around to do something about it!

Those with big lifts etc would be wise to consider where they park their vehicles I reckon.

Wont be long til the rest of the country follows suit i think.

The new inspection laws seem a bit rough IMO. I do get the issue with cars with serious defects sticking out like dogs balls though like bald tyres etc and not being able to do anything previous.
Just negates the ability to correct the officer when they think the rear lights you have on your roof rack are hooked up as reverse lights or something else they tend to come up with.

Lets just hope they dont abuse this new law

Lets just hope they dont abuse this new law. They will eventually, not necessarily "abuse" but by not knowing and making an error or just in a bad moode. When blanket laws are made and some or any of the people charged with implimenting them don't fully understand them, mistakes will happen. i saw some comentary recently about SA cops being a bit rough on 4x4's. My brother in law heading over in his disco last year blew a headlight globe late afternoon, not dark enough to notice it yet. Cops pulled him over and instead of telling him to fix it or park up after dark, issued a fine and order to fix. He had to interrupt the trip to fit a new globe and then attend an inspection station. Even the inspector coildn't understand the reason for the inspection and defect note. Point is most will give a bit of leaway but thetre will always be some who will go by the letter of the law and they will be the ones we will hear about. Incidently, I travel for about 20mins each day in the freeway here, and the number of tradies trailers with no lights or random lights and/or bald tyres is incredable. Frustrating when you take your camper out and are a kg over weight or you get pinged for a light not working that you didn't know about.

OK here you go, direct from the horses mouth as it were. I asked on another forum where a member who is a serving police officer had posted.

I can now put an un roadworthy sticker on the car and leave a ticket for the owner/driver in any public place when he isn't on the spot. Bit like a parking ticket really. Normally, when you find the car with say bald tyres parked in the street you have to be prepared to wait around for him to come back or follow up at the registered address.[/quote]

Hi Grahame,
Can you clarify for me that a vehicle or trailer must be parked in a public place?

Eg. could a 4wd with a 6" lift & 37" tyres be 'canaried' if it is a) parked in the owner's driveway or b) if it were seen in an off-road situation which would have required driving on public roads to reach it? Alternatively what if the vehicle had been trailered to such a location?

I'm asking not because I have such a vehicle, but because it has been asked on a 4wd forum I am a member of.

Hi. It would need to be in a public place.

In answer to (a) not in an owners driveway,

And (b) certainly can in an off road situation that is on public land, but not on someone’s private land and not whilst being trailered.

Basically the way I read it, if it needs to be registered to be used where it’s being used, it can be canaried with or without the owner present.

I will look into it more tomorrow

Cheers.

They can’t defect it if it’s been engineered...

If it’s been engineered and has documentation then it’s not unroadworthy. That’s nothing new and has always been the case.

As for drink driving they can get you on private property according to our local cop , I've stopped doing it since the hand op because I can't hold a can in one hand and drive with the other .

I wonder if us Mexicans will oneday be given a ‘Recreational Registration’ option too for trailering weapons up to the many off Hema map HC tracks if so inclined?
Seems to be ok for trailbike weapons for many years now legally.
