So Tans pop passed away a while ago now. And they have just put up the car (3l gu) for sale. Vic roads are now telling them that the Nan has to pay $1000 to transfer the car into her name. Has anyone ever heard of this and should the price be so hi.

I don't think you would have to pay that if you sell it a deceased estate.

Exactly. They are saying she has to pay it to sell it as it is not in her name and the fact it is so much.

Why so high?

I know you don't need to supply a rwc transferring between family members.

See this link for exemptions reductions of stamp duty on transfer of reg in Vic.

I don't know if the $1,000 is before or after a reduction as a beneficiary but I would suggest another enquiry to Vic Roads may be appropriate.

If the estate has already been thru probate etc then there may be an issue

I believe she needs to go to vicroads with a wedding and death certificate and they should change it over for free. Well, that was the case 5 years ago when my MIL did it.

Hi,
Kat is right, I transferred my late dads car into my name for something like $25 a few years ago (not sure of the price), no RWC required. I was the executor and a beneficiary. VicRoads didn't even know the rules themselves at the time.
Transfer to a partner (wife) would be similiar, she can then on sell as she chooses. Maybe it's different if the estate is selling it so best transfer over first, 10 min job.
Busy at the moment but will check tomorrow when I get a chance.

Hello Kev,

Had a quick look at this on the website and doesn't look like anything has changed. Free to transfer to the surviving partner who can then dispose of the vehicle as they wish.

https://www.vicroads.vic.gov.au/registration/buy-sell-or-transfer-a-vehicle/transfer-a-vehicle/transfer-from-a-deceased-estate (then download the first link)

Suggest you call them again as they had no idea when I when through this.
