Its the blaster next door. Obviously he has poor emissions controls in place and is damaging property off site..

In NSW I believe that the ACT is the Protection of the Environment Operations Act 1997 No 156 Section 5.4 for emissions. If there are a number of other parties all trying to claim against this guy and their insurer has taken action against him, then you should not have to pay the excess.
Also if he has had to pay previously there is precedent that he has admitted fault for this prior.
Might be worthwhile contacting the EPA to see if they could conduct a particulate study on his stacks, would be useful in your claim if he is found wanting? - Good Luck with it

Mate, get up and have a look in the gutters of your workshop, take some pics too.
This would give a good idea of the fallout from next door..
Your paintwork looks as tho someone has been angle grinding near your car, but exhaust fans from factories can carry metal fragments as well.

So I heard from the insurer today, They have selected the repairer for my car, I think he said they quoted $3200 or $3600 to do the job, But he wanted to check with them first and make sure it was all getting done etc, then it would be good to go.
As for the excess, because this is a 3rd party claim it is different to if someone had hit my car while parked as an example, and they need to prove him as the person causing the damage. Once they do that I get my excess back.

Bummer, it looks like you have this problem straight away, maybe tell the insurance your not happy, because your doors are a completely different shade of white to the front gaurd and the rear quarter ?
